Studied without consent: hairy informed consent issues

On Monday, Duke University will begin “enrolling” patients in a “study on PolyHeme”:http://www.wral.com/news/4734077/detail.html, a synthetic blood compatible with all blood types with a shelf life of a year. Since emergency victims are the patients, an informed consent (required in all but weird cases, including studies on emergency trauma victims) will not be required. There are opt-out strategies, such as sending email to some guy at Duke, but quite frankly this seems unwieldy.
